The State Stipulates That Production And Business Units Must Install Combustible Gas Alarm Devices

At 6:02 on July 17, 2023, a gas tank explosion occurred at a barbecue restaurant on Huyang Road, Tanghe Street, Jianhu County, Yancheng City, Jiangsu Province, causing 1 death and 1 injury. The injured have been sent to hospital for treatment in time. At present, Wu, the shop owner involved, has been controlled by the public security organs, and related work such as the aftermath of the accident and the investigation of the cause are ongoing. ​
The “Work Safety Law of the People’s Republic of China” has clearly stipulated that the maximum fine for failure to install a flammable gas alarm device is 200,000 yuan!
Article 36 of the “Work Safety Law of the People’s Republic of China” clearly stipulates that “production and business units in catering and other industries that use gas must install flammable gas alarm devices and ensure their normal use.”
Penalty standards have been clarified for nine major behaviors including the use of gas by production and business units in catering and other industries without installing flammable gas alarm devices:
Order to make corrections within a time limit and impose a fine of not more than 50,000 yuan; if corrections are made within the time limit, a fine of not less than 50,000 yuan but not more than 200,000 yuan will be imposed, and the person in charge and other directly responsible personnel directly responsible for the violation will be fined not less than 10,000 yuan but not more than 20,000 yuan. The following fines shall be imposed; if the circumstances are serious, the company shall be ordered to suspend production and business for rectification; if a crime is constituted, criminal liability shall be investigated in accordance with the relevant provisions of the Criminal Law.

This also means that starting from September 1 this year, production and business units that use gas, such as the catering industry, will gradually install gas alarms. In the future, relevant government departments will increase their efforts to guide and even force the installation of gas alarms from a regulatory perspective.

In view of the potential safety hazards in the use of gas in the catering industry and the irregular use of alarm equipment related to production safety, the new “Safety Production Law” also stipulates: “Production and business units shall not close or destroy the monitoring, alarm, protection, and life-saving functions that are directly related to production safety.” Equipment and facilities, or tampering with, concealing, or destroying their relevant data and information.”
